DMCA & Copyright Policy

On this page

This DMCA & Copyright Policy explains how FRESCOR.org handles claims that material on frescor.org infringes copyright or other rights, how to send us a notice, how to respond if your material was removed, and how to ask us to correct an image attribution. We respect the rights of creators and aim to deal with every report fairly and promptly.

    Key takeaways

    • Send copyright notices to support@frescor.org with the subject line “DMCA Notice”.
    • A valid U.S. notice must include the six elements listed in 17 U.S.C. §512(c)(3).
    • Notices from the EU and UK are handled through an equivalent notice-and-action process aligned with Article 16 of the Digital Services Act.
    • For a missing or incorrect image credit, a quick e-mail is usually all it takes, and we fix most attribution issues within a few business days.

    1. Our respect for intellectual property

frescor.org publishes original articles and tools, preserves archive material from the historical FRESCOR research project, and uses images and other material from third parties under their licenses. We take care to use material lawfully: original content is written by our own authors, archive material is reproduced for historical and educational purposes with credit to its original authors, and third-party images are used under licenses listed on our Image Credits page.

Mistakes can still happen. If you believe material on the Site infringes your copyright or is otherwise unlawful, please tell us using the process below. We will investigate and, where appropriate, remove or disable access to the material.

If your concern is only about how your work is credited, for example a missing author name or the wrong license, you do not need to send a formal legal notice. See Section 9 for the quicker attribution correction process.

    2. How to file a copyright infringement notice (DMCA)

If you are a copyright owner, or are authorized to act on behalf of one, you may send us a written notice under the U.S. Digital Millennium Copyright Act (DMCA). To be effective under 17 U.S.C. §512(c)(3), your notice must include the following:

    1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed. A typed full name at the end of an e-mail is generally accepted as an electronic signature.
    2. Identification of the copyrighted work claimed to have been infringed or, if multiple works on the Site are covered by a single notice, a representative list of those works.
    3. Identification of the material that is claimed to be infringing and that is to be removed or disabled, with information reasonably sufficient to permit us to locate it. Please give the full URL of each page and, where relevant, describe the specific image, passage or file.
    4. Your contact information, reasonably sufficient for us to contact you, such as your name, postal address, telephone number and e-mail address.
    5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
    6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Before sending a notice, please consider whether the use may be licensed (for example under a Creative Commons license), may qualify as fair use or another exception or limitation, or may concern material that is not protected by copyright. Notices that do not substantially comply with the requirements above may not be acted on, but we will usually contact you to ask for the missing information.

    3. Where to send your notice

Send your notice by e-mail to support@frescor.org with the subject line “DMCA Notice”. Using this subject line helps us identify and prioritize your message. If you prefer to send a notice by post, you can use our postal address: available on request via support@frescor.org.

Please send only copyright and related legal notices to this address with that subject line. For general questions, use our contact page.

When we receive a valid notice, we may forward a copy, including your name and the details of your complaint, to the person who provided the material, so that they can respond. We may also keep a record of the notice. Personal data in notices is handled according to our Privacy Policy.

    4. Counter-notification

If material you provided was removed or disabled following a notice and you believe this was the result of a mistake or misidentification, you may send us a counter-notification under 17 U.S.C. §512(g). In practice, most material on the Site is published by us, so counter-notifications are most likely to be relevant to comments or other user submissions, or to rights holders of material we published under a license. To be effective, a counter-notification must include:

    1. Your physical or electronic signature.
    2. Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which it appeared before it was removed or disabled.
    3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
    4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original notice or an agent of that person.

Send counter-notifications to support@frescor.org with the subject line “DMCA Counter-Notice”. On receiving a valid counter-notification, we will forward it to the person who sent the original notice. Unless that person informs us within 10 business days that they have filed a court action seeking to restrain the alleged infringement, we may restore the material no fewer than 10 and no more than 14 business days after receiving the counter-notification.

    5. Repeat infringer policy

In appropriate circumstances, we will terminate the accounts and block the submissions of users who are repeat infringers. A user may be considered a repeat infringer if valid notices have been received regarding material they submitted on more than one occasion, or if we otherwise determine, in our reasonable judgment, that they have repeatedly infringed others’ rights. We may also restrict access for users who have infringed only once, depending on the circumstances.

    6. Misrepresentation warning

Please be careful and truthful when sending a notice or counter-notification. Under 17 U.S.C. §512(f), any person who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, the copyright owner or the service provider. If you are not sure whether material infringes your rights, consider seeking legal advice first.

    7. EU and UK notice-and-action process

If you are in the European Union, you can notify us of material you consider to be illegal content, including copyright infringement, under a notice-and-action process aligned with Article 16 of the Digital Services Act (Regulation (EU) 2022/2065). We also apply the same process to notices from the United Kingdom and elsewhere. You do not need to refer to U.S. law.

    What your notice should contain

    1. A sufficiently substantiated explanation of why you consider the material to be illegal content, for example which right is infringed and why.
    2. A clear indication of the exact electronic location of the material, such as the exact URL or URLs, and any additional information needed to identify it.
    3. Your name and e-mail address (or the name and e-mail address of the organization you represent).
    4. A statement confirming your bona fide belief that the information and allegations in the notice are accurate and complete.

Send the notice to support@frescor.org, using the subject line “DMCA Notice” or “Illegal Content Notice”.

    What happens next

    • We send a confirmation of receipt to the e-mail address you provide, without undue delay.
    • We review the notice in a timely, diligent, non-arbitrary and objective manner. Decisions are made by a person and not by automated means.
    • We tell you our decision and the reasons for it, and explain any options you have to seek redress.
    • If we remove or restrict material provided by a user, we give that user a statement of reasons, and they may ask us to review the decision.

Nothing in this process affects your right to go to court or to contact the relevant authorities.

    8. Processing timelines

    Step Our target
Acknowledge receipt of a notice or counter-notification Within 2 business days
Request missing information from an incomplete notice Within 3 business days
Review a complete notice and remove or disable clearly infringing material Usually within 5 business days, often sooner
Inform you of our decision and reasons When the decision is made
Restore material after a valid DMCA counter-notification (if no court action is filed) 10 to 14 business days after receipt
Correct an image attribution or license notice Usually within 5 business days

These are targets, not guarantees. Complex cases, such as disputes about ownership of historical archive material, may take longer, in which case we will keep you informed.

    9. Open-licensed images and attribution corrections

Some images on the Site are used under open licenses such as Creative Commons licenses (for example CC BY or CC BY-SA), or are in the public domain. Where a license requires attribution, we aim to credit the author, link to the source, name the license and indicate whether the image was modified. Credits are collected on our Image Credits page and, where practical, near the image itself.

If you are the creator of an image or other work used on the Site and the credit is missing, incomplete or wrong, or you would prefer to be credited differently, please e-mail support@frescor.org with the subject line “Attribution correction” and include:

    • the URL of the page where the work appears and a description of the work;
    • the original source of the work (for example the URL on Wikimedia Commons or your own website);
    • the correct author name or credit line you would like us to use; and
    • the license under which the work was published, if you know it.

We will correct the attribution, or replace or remove the work if you prefer. If you believe our use of an open-licensed work does not comply with its license terms, please tell us. We will work to bring our use into compliance quickly, which is usually the most effective outcome for everyone.

    FRESCOR project archive material

Archive material from the historical FRESCOR project is reproduced for historical and educational purposes, and belongs to its original authors and rights holders. If you are an original author or rights holder and would like material to be credited differently, updated, linked to its original source or removed, please contact us. We will respond respectfully and promptly.
