Refund & Cancellation Policy

On this page

This Refund & Cancellation Policy explains when and how you can cancel an order placed with FRESCOR.org on frescor.org, and how refunds are handled. It covers our professional services (schedulability audits, consulting, timing analysis, Linux tuning and training workshops) and our digital eBook. It forms part of our Terms and Conditions. Nothing in this policy limits your statutory rights as a consumer.

    Key takeaways

    • If you are a consumer in the European Union, you usually have 14 days to withdraw from an online purchase without giving a reason.
    • That right ends for the eBook once the download starts, and for services once they are fully performed, provided you gave your express consent beforehand.
    • If you cancel a service that is already under way, you pay only for the work done; the rest is refunded pro rata.
    • Workshop cancellations follow a notice-period table: full refund with more than 30 days’ notice, 50% with 15 to 30 days, and a credit or transfer with 14 days or less.
    • Refunds are made within 14 days, to your original payment method.

    Scope of this policy

This policy applies to the following products and services sold through our services page:

Where a separate written proposal, statement of work or service agreement has been signed for a specific engagement, its cancellation and payment terms take precedence over this policy, unless the law requires otherwise.

    Consumers and business customers

Many of our customers buy on behalf of a company or another organization. The statutory right of withdrawal described below is a consumer right: it applies to individuals buying for purposes outside their trade, business, craft or profession. Business customers do not have a statutory right of withdrawal. However, the pro-rata, workshop and refund procedures in this policy apply to business customers too, unless a separate agreement says otherwise.

Your 14-day right of withdrawal (EU consumers)

Under EU consumer protection law (Directive 2011/83/EU on consumer rights, as implemented in each Member State), consumers who buy online generally have the right to withdraw from the contract within 14 days without giving any reason. Similar rules apply in some countries outside the EU, including the United Kingdom.

    • For services, including workshops, the 14-day period starts on the day the contract is concluded, which is normally the day you receive our order confirmation.
    • For digital content, such as the eBook, the 14-day period also starts on the day the contract is concluded.

To exercise the right of withdrawal, you must send us a clear statement of your decision to withdraw before the period expires. Email to support@frescor.org is the quickest way. You may use the model wording below, but it is not required:

To FRESCOR.org: I/We hereby give notice that I/we withdraw from my/our contract for the supply of the following service / digital content: [description]. Ordered on [date]. Order number: [number]. Name of consumer(s): [name]. Date: [date].

It is enough to send your notice before the 14-day period ends.

Exceptions to the right of withdrawal

The law sets out situations in which the right of withdrawal does not apply or ends early. Two of them are relevant to our products:

Situation When the right of withdrawal is lost Conditions
Digital content not supplied on a physical medium (the eBook) When the download or access begins You gave your prior express consent to immediate supply during the withdrawal period, and acknowledged that you would lose your right of withdrawal once supply begins.
Services When the service has been fully performed Performance began with your prior express request and consent, and you acknowledged that you would lose your right of withdrawal once we have fully performed the contract.

We ask for this consent and acknowledgment explicitly at checkout, and confirm your choice in the order confirmation. If you do not give consent, we will not start a service or release the eBook download until the withdrawal period has passed.

    The eBook (digital content)

The Embedded Timing Field Guide is delivered as a downloadable PDF file. Because a digital file cannot be “returned”, the following rules apply:

    • Before you start the download, you can withdraw within 14 days and receive a full refund.
    • Once the download has started, and you have given the express consent and acknowledgment described above, the right of withdrawal no longer applies and the purchase cannot be refunded on that basis.
    • Faulty or incorrect files are always our responsibility. If the file is corrupted, incomplete, materially different from its description, or cannot be opened in a standard PDF reader, contact us. We will first try to fix the problem by supplying a working file. If we cannot, you are entitled to a price reduction or a full refund, in line with your statutory rights for digital content.
    • Accidental duplicate purchases of the same eBook by the same customer will be refunded on request.

    Professional services and pro-rata refunds

Our audits, consulting, timing analysis and Linux tuning services are planned and delivered in stages. Typical stages include scoping, information gathering, analysis, a draft report and a final report or handover session. Each order or proposal describes the stages for that engagement.

    Cancelling before work starts

If you cancel before we have started any work, you receive a full refund. This applies whether or not you are within the statutory withdrawal period.

    Cancelling during the work

If you cancel after work has started but before it is complete, you pay only for the work performed up to the moment you notified us. We refund the rest. This applies to consumers who requested an early start and then withdraw within 14 days, as well as to all customers who cancel later in the engagement.

We calculate the amount payable as a proportion of the total price, using whichever measure was stated in your order or proposal:

    • Milestones: the share of the price assigned to each milestone that has been completed, plus a fair share of any milestone in progress.
    • Time: the hours or days actually spent, at the rate used to calculate your quote.
    • Otherwise: a fair estimate of the share of the total work completed.

On request, we will provide a short breakdown of the work completed. Any work products completed up to the cancellation date, such as notes, intermediate analysis results or a draft report, will be delivered to you.

    After full performance

Once a service has been fully performed, the contract is complete and it cannot be cancelled. If you believe the service was not delivered as described, or contains errors, please tell us. We will correct genuine shortcomings in our deliverables free of charge. Where this is not possible, we will agree a fair price reduction or refund with you.

    If we cancel

If we cannot deliver a service, for example because of illness or other circumstances beyond our control, we will tell you promptly. You can then choose a new schedule or a full refund of any amount paid for work not yet delivered.

    Workshops: cancellation and rescheduling

The Contract-Based Scheduling Training Workshop is booked for specific dates, and we reserve trainer time and prepare materials in advance. Cancellations and changes are handled according to how much notice you give before the first workshop day:

Notice before the workshop starts Cancellation Rescheduling
More than 30 days Full refund (100%) Free move to another available date
15 to 30 days 50% refund Free move to another available date (once per booking)
14 days or less No cash refund; full credit toward a future workshop, or transfer of your place to a colleague Credit toward a future date, subject to availability
No-show without notice No refund or credit Not available

    Additional points:

    • Withdrawal period first. If you are a consumer and you withdraw within the 14-day statutory period, you receive the refund the law provides, even if the table above would give you less. If the workshop has already been partly delivered at your request, you pay a proportionate amount for the sessions that took place.
    • Substitutions are welcome at any time at no extra cost. Simply tell us the name and email address of the new participant.
    • Credits are valid for 12 months from the date of the original workshop and can be used for any of our workshops.
    • Private or in-house workshops organized for a single organization follow the cancellation terms in the agreed proposal.
    • If we cancel or postpone a workshop, for example because too few participants have registered or the trainer is unavailable, you can choose a full refund or a place on a new date. We are not responsible for travel or accommodation costs you have booked, so we recommend flexible bookings.

How to request a cancellation or refund

To cancel an order or request a refund, email support@frescor.org and include:

    1. Your full name and the email address used for the order.
    2. Your order number (shown in your order confirmation email).
    3. The product or service concerned.
    4. Whether you are exercising the statutory right of withdrawal, cancelling a service or workshop, or reporting a problem with a product.
    5. For faulty eBook files, a brief description of the problem (for example, the error message and the PDF reader you used).

We will acknowledge your request, normally within two business days, and confirm the refund amount, if any. You can also write to us at available on request via support@frescor.org.

    Refund timelines and method

    • Timing. We issue refunds without undue delay, and in any case within 14 days of receiving your withdrawal notice or of agreeing a refund with you.
    • Method. Refunds are made using the same payment method you used for the original purchase, unless you expressly agree to a different method. You will not be charged any fee for the refund.
    • Processing time. After we issue a refund, your bank or payment provider may take a few more business days to show it in your account. This is outside our control.
    • Currency. Refunds are made in the currency of the original payment. We are not responsible for differences caused by exchange-rate changes or fees charged by your bank.

    Chargebacks and payment disputes

If you have a problem with an order, please contact us first. Most issues can be resolved quickly and directly, and a direct refund is usually faster than a dispute through your bank or card provider.

Your right to dispute a payment with your card issuer or payment provider is not affected by this policy. If a chargeback is opened, we will provide the payment provider with the relevant order details, including any consent records collected at checkout and evidence of delivery or download, so that the dispute can be assessed fairly. If a chargeback is opened for an amount we have already refunded, we will ask the provider to close it.

    Changes to this policy

We may update this policy from time to time, for example to reflect new products or changes in the law. The version that applies to your order is the one published on frescor.org when you placed the order. The “Last updated” date at the top of this page shows when it was last revised.
