2. Acceptance of these terms
By accessing or using the Site you agree to these Terms and Conditions, our Privacy Policy, our Cookie Policy and our Disclaimer. When you place an order you will be asked to confirm that you accept these terms, and they will form part of the contract between you and us. If you do not agree, please do not use the Site or place an order.
Where a separate written agreement or signed statement of work exists between you and us for a particular engagement, that agreement takes precedence over these terms to the extent of any conflict.
3. Eligibility
You may browse the Site at any age, but the Site is not directed at children under 16. To create an account or place an order, you must be at least 18 years old (or the age of majority where you live) and legally able to enter into a binding contract. Business customers must provide accurate company details, including a valid VAT or tax identification number where applicable.
4. Use of the Site
We grant you a limited, non-exclusive, non-transferable, revocable permission to access and use the Site for your personal, educational or internal professional purposes, in line with these terms. You may:
- read, print and save individual pages for your own reference;
- share links to any page of the Site;
- quote short extracts with clear attribution and a link to the source page; and
- use the schedulability calculator and other interactive tools for learning and exploration.
We may change, suspend or withdraw any part of the Site at any time without notice. We aim to keep the Site available, but we do not guarantee uninterrupted access, and we are not liable if the Site is unavailable for any period.
If you create a customer account, you are responsible for keeping your login details confidential and for all activity under your account. Tell us promptly at support@frescor.org if you suspect unauthorized use.
5. Intellectual property
5.1 Our content
Unless stated otherwise, the original articles, guides, glossary entries, tools, design, code and other material on the Site are © FRESCOR.org and are protected by copyright and other intellectual property laws. Apart from the permitted uses in Section 4, you may not copy, republish, sell, frame, scrape in bulk, or create derivative works from our content without our prior written permission. Requests can be sent to support@frescor.org.
5.2 FRESCOR project archive material
The Site preserves material from the historical FRESCOR research project (2006–2009), funded under the European Union’s Sixth Framework Programme. Preserved archive material, such as project descriptions, deliverables, papers and partner information, belongs to its original authors and rights holders. It is reproduced for historical and educational purposes only, and no ownership of it is claimed by us. Your use of that material may be subject to the terms set by its original authors. If you are a rights holder and have concerns about how archive material is presented, please see our DMCA & Copyright Policy or contact us.
5.3 Third-party images and material
Some images and other material on the Site are provided by third parties under their own licenses, such as Creative Commons licenses or stock image licenses. Those licenses, not these terms, govern your use of that material. Attribution and license details are listed on our Image Credits page.
5.4 Trademarks
Names of products, operating systems, tools and organizations mentioned on the Site may be trademarks of their respective owners. Their use on the Site is for identification and descriptive purposes only and does not imply endorsement.
6. User submissions
When you send us messages, feedback, corrections, comments (where enabled) or project materials, you confirm that you have the right to share them and that they do not infringe anyone else’s rights. For feedback, suggestions and corrections that relate to the Site’s content, you grant us a worldwide, royalty-free, non-exclusive license to use them to improve the Site. We will not publish your name alongside any submission without your permission.
Materials you provide to us as part of a paid engagement, such as source code, timing traces or system documentation, remain yours. We use them only to perform the Services and treat them as confidential, as described in Section 8.
We may remove or decline to publish any comment or submission at our discretion, for example if it is off-topic, unlawful, or violates Section 7.
7. Acceptable use
You must not use the Site to:
- break any applicable law or regulation, or infringe anyone’s intellectual property, privacy or other rights;
- attempt to gain unauthorized access to the Site, its server, database or any account, or probe, scan or test its vulnerabilities without our written permission;
- introduce malware or launch denial-of-service, brute-force or similar attacks;
- scrape, harvest or bulk-download content or data by automated means, except for search engine indexing that respects our robots.txt rules;
- use the Site’s content to train or fine-tune machine learning models without our written permission;
- send spam, unsolicited advertising or misleading messages through our forms;
- impersonate any person or organization, or misrepresent your affiliation with anyone; or
- interfere with other users’ use of the Site.
We may block access, suspend accounts or take other appropriate action if we reasonably believe these rules have been broken. Our security tools may block suspicious traffic automatically.
8. Services and Digital Products ordered via WooCommerce
8.1 Product information and quotes
Descriptions of Services and Digital Products on the Site are an invitation to order, not a binding offer. Some Services are sold at a fixed price, while others require a quote. When you request a quote, we will provide a written proposal setting out the proposed scope, deliverables, timeline and price. Quotes are valid for 30 days unless stated otherwise.
8.2 Formation of the contract
A contract is formed when we confirm your order by e-mail or, for quoted Services, when you accept our written proposal or statement of work. We may decline an order, for example if a Service is unavailable, if there is an obvious pricing error, or if we cannot carry out the work competently within the requested timeframe. If we decline after you have paid, we will refund you in full.
8.3 Scope and statement of work
Each Service is defined by its product description and, where applicable, a statement of work (“SOW”) agreed between us. The SOW describes the system and questions in scope, the inputs you will provide (such as source code, task models, hardware access or traces), the deliverables, assumptions, and the timeline. Work outside the agreed scope is not included. If you would like to change the scope, we will agree any changes, and any effect on price or timeline, in writing before the extra work begins.
Our ability to deliver on time depends on your providing accurate and complete information and access when agreed. Where delays are caused by missing or late inputs, delivery dates will be adjusted accordingly.
8.4 Deliverables
Typical deliverables include written reports, analysis results, configuration recommendations, training materials and recorded or live sessions, as described in the product page or SOW. Unless otherwise agreed, once you have paid in full you receive a non-exclusive, perpetual license to use the deliverables for your internal business purposes. We keep ownership of our pre-existing know-how, templates, tools and generic materials, and may reuse general knowledge gained, but we will never disclose your confidential information.
8.5 Confidentiality
We keep confidential any non-public information you provide in connection with a Service and use it only to perform that Service. This obligation does not apply to information that is public, already known to us, independently developed, or that we are legally required to disclose. If you need a separate non-disclosure agreement, we are happy to sign a reasonable one before the engagement starts.
8.6 Pricing, taxes and payment
- All prices are stated in euros (EUR).
- Prices for consumers include any applicable VAT or sales tax as calculated at checkout. For business customers, VAT may be charged or reverse-charged depending on your location and tax status. Any tax will be shown before you confirm your order.
- Payment is made through the payment methods offered at checkout. For larger quoted Services, we may require a deposit or staged payments as set out in the SOW.
- Unless stated otherwise in an invoice, invoices for quoted Services are due within 14 days.
- Your bank or payment provider may charge currency conversion or transaction fees, which are your responsibility.
- We may change our prices at any time, but changes will not affect orders already confirmed.
8.7 Digital Product license
When you buy a Digital Product, such as a PDF eBook, you receive a non-exclusive, non-transferable license to download and use it according to the license type purchased:
- Personal license: for use by one individual, on any devices they own.
- Single-team license (where offered): for internal use by one team within one organization, normally up to the number of people stated on the product page.
You may not resell, redistribute, share publicly, upload to file-sharing services, or remove copyright notices from Digital Products. Files may contain a personalized watermark or order reference. Download links are valid for the period stated in your order confirmation; if a link expires, contact us and we will reissue it.
8.8 Cancellations and refunds
Your rights to cancel orders and receive refunds, including how the statutory right of withdrawal applies to consumers for Services and Digital Products, are described in our Refund Policy, which forms part of these terms.
9. No professional certification or safety guarantee
Our articles, tools and Services are designed to help engineers understand and improve the timing behavior of embedded systems. They do not constitute safety certification, regulatory approval, or a guarantee that a system meets any standard such as DO-178C, ISO 26262, IEC 61508 or EN 50128. Analysis results depend on the models, data, assumptions and access provided, and on factors outside our control. You remain solely responsible for the design, verification, validation, certification and safe operation of your systems, and for engaging appropriately qualified and accredited professionals where required. Please also read our Disclaimer.
10. Links to third-party sites
The Site contains links to external websites, documentation and resources that we think are useful. We do not control those sites and are not responsible for their content, availability, accuracy or privacy practices. A link does not imply endorsement. Your use of third-party sites is governed by their own terms.
11. Disclaimer of warranties
We work hard to keep the Site’s content accurate and useful, and we review it as described in our Editorial Policy. However, the Site, its content, the archive material and the interactive tools are provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose or non-infringement, in relation to the free content of the Site.
For paid Services, we will perform them with reasonable care and skill, in line with generally accepted professional practice. For Digital Products, we warrant that they will materially match their description. If you are a consumer, you also have statutory rights regarding the conformity of goods, digital content and services, and nothing in these terms limits them.
12. Limitation of liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.
Subject to that:
- We are not liable for any loss or damage arising from your use of, or reliance on, the free content, tools or archive material on the Site.
- For business customers, we are not liable for loss of profits, revenue, business, contracts, anticipated savings, data or goodwill, or for any indirect or consequential loss, however caused.
- For business customers, our total liability arising from or in connection with any order, whether in contract, tort (including negligence) or otherwise, is limited to the total amount you paid for the Service or Digital Product concerned.
- For consumers, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for business losses, since our Digital Products are supplied for personal use under a personal license.
13. Indemnity
If you are a business customer, you agree to indemnify us against any claims, losses, damages and reasonable costs (including legal fees) arising from your breach of these terms, your misuse of the Site or Digital Products, or your use of our deliverables in a way that was not agreed, including any claim that materials you provided to us infringe a third party’s rights. This section does not apply to consumers except to the extent permitted by applicable law.
14. Suspension and termination
We may suspend or terminate your access to the Site or your account if you materially breach these terms, if required by law, or to protect the Site and other users. You may close your account at any time by contacting support@frescor.org.
Either party may terminate an ongoing Service engagement by written notice if the other materially breaches these terms and does not remedy the breach within 14 days of being asked to do so. On termination, you will pay for work properly performed up to the termination date, and we will deliver any completed work in progress. Sections that by their nature should survive termination, including intellectual property, confidentiality, limitation of liability, indemnity and governing law, will continue to apply.
15. Events outside our control
We are not responsible for delays or failures to perform caused by events outside our reasonable control, such as natural disasters, serious illness, internet or power outages, cyberattacks or governmental action. If such an event affects a Service, we will tell you as soon as possible and agree a new timeline or, if that is not possible, refund any amount paid for work not performed.
16. Governing law
These terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of the country in which FRESCOR.org is established, without prejudice to mandatory consumer protection law of your country of residence. If you are a consumer, you therefore keep the protection of the mandatory provisions of the law of the country where you live, and you may bring proceedings in the courts of that country.
17. Dispute resolution
If you have a complaint, please contact us first at support@frescor.org. We will acknowledge your complaint promptly and aim to resolve it within 30 days. Most issues can be settled quickly by talking to us directly.
If we cannot resolve a dispute informally, business customers agree that the courts of the country in which FRESCOR.org is established will have jurisdiction. Consumers may bring proceedings in the courts of their country of residence or of the country where we are established.
EU online dispute resolution: the European Commission’s Online Dispute Resolution (ODR) platform was discontinued in July 2025 under Regulation (EU) 2024/3228. Consumers in the EU can still use out-of-court alternative dispute resolution (ADR) bodies in their country, and national consumer authorities can provide information about them. We are not obliged to participate in ADR procedures, but we will consider any proposal in good faith.
18. Severability and general terms
- Severability: if any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full force, and the affected provision will be applied to the maximum extent permitted.
- No waiver: if we do not enforce a right immediately, that does not mean we have waived it.
- Assignment: we may transfer our rights and obligations under these terms to another organization, provided your rights are not reduced. You may not transfer your rights without our written consent.
- Entire agreement: these terms, together with the policies referenced in them and any SOW or written agreement for a specific engagement, form the entire agreement between us regarding their subject matter.
- Third parties: no one other than you and us has any right to enforce these terms.
- Language: these terms are written in English, and the English version prevails over any translation.
19. Changes to these terms
We may update these terms from time to time, for example to reflect changes in the law, our Services or how the Site works. The updated version will be published on this page with a new “Last updated” date. Changes do not affect orders already confirmed; the terms in force when you placed an order apply to that order. Your continued use of the Site after changes are published means you accept the updated terms.
